General Terms and Conditions (GTC)

1. General, Scope

a) The following General Terms and Conditions are part of all our offers and contracts with all customers, including current and future business relationships. They are deemed agreed upon if they are not immediately objected to.

b) We only recognize conflicting conditions or conditions of the customer that deviate from our terms and conditions if we expressly agree to their validity in writing.

2. Offer, Conclusion of Contract and Performance

a) All offers are subject to change until the order is accepted.

b) Acceptance of the offer can be made by the client in writing, orally, or by telephone.

c) Work that exceeds the originally agreed scope of the order or the offer will be billed according to proof as far as possible according to the unit prices of the offer, otherwise according to additional material costs and/or hourly rates based on reports.

3. Acceptance

a) If a formal acceptance is contractually provided for, the acceptance effect also occurs if the client has been summoned twice in vain and in a reasonable manner to carry out the acceptance. The acceptance effect occurs twelve working days after receipt of the second request.

4. Warranty Claims

a) my Garden S.à.r.l. must provide the customer with its performance free of material defects at the time of acceptance. The performance is free of material defects at the time of acceptance if it has the agreed quality and corresponds to the recognized rules of technology.

b) Unless separate deadlines are agreed in the contract, the statutory deadlines apply to warranty claims.

5. Prices and Payment

a) Interim invoices based on construction progress and/or material costs are due as agreed.

b) Unjustified discount deductions will be reclaimed. Invoicing takes place according to measurement and report (except for lump sum offers).

d) In the event of late payment, interest will be charged. The default interest rate is 5 percentage points above the base rate.

6. Retention of Title

Delivered items remain the property of the contractor until full payment of the remuneration.
